Solstice Medicine Company distributes products that require warning statements to California residents. These products may contain detectable amounts of naturally occurring toxins such as arsenic, cadmium, lead, and mercury. These elements are not added by man, or due to human activities. You can obtain more Proposition 65 information at www.P65warnings.ca.gov. To remain in compliance with Proposition 65 requirements Solstice routinely tests for the presents of listed chemicals and will label finished goods accordingly lot-by-lot.

For those valued wholesale partners to whom we ship product to a California address, Solstice Medicine Company acknowledges your distribution business model is not limited to the State of California. The products purchased from Solstice Medicine Company may be further be sold and distributed to customers outside the State of California. Solstice Medicine Company is willing to provide your firm with unlabeled product under the following conditions listed below.

It is your firm’s responsibility to ensure applicable products have prominent and conspicuous warning at the point of sale in California. Furthermore, you must appropriately notify those customers the product may expose a person to certain chemicals listed by the State of California which are known to cause cancer, birth defects, or other reproductive harm.

Solstice Medicine Company herby notifies your firm that products require a clear and reasonable warning to California based customers before knowingly and intentionally exposing them to listed chemical(s) as per California Health and Safety Code Section 25249.5 ET SEQ (hereinafter listed as P65). Solstice Medicine Company will ship product without a warning statement because your firm is requesting Solstice provide products without any on-product P65 warnings. Solstice is willing to comply with your request under the following conditions.

  • Your firm sign this acknowledgment letter, commit to take all responsibility warning the California customers/consumers in full compliance with the regulations, and return the signed responsibility and indemnity letter to us.
  • Your firm apply appropriate P65 warning stickers when sales are to California residents and be willing to send working examples upon our request.

Proposition 65 requires either of the following warning statement formats.

As a potential California distributor you agree to indemnify and hold harmless Solstice Medicine Company for any loss, damage, claim, injury, or expense, including attorneys’ fees, asserted against any of them, by reason of any injury, demand, claim or suit arising out of negligence its/her/his employees and/or agents, in connection with distributing of unlabeled products in the State of California.
